NMB BREAKING NEWS: Judge denies Phyllis Smith’s Motion to Dismiss!

Breaking newsIn a telephonic hearing today, Circuit Court Judge Samantha Ruiz Cohen DENIED Phyllis Smith’s Motion to Dismiss the absentee ballot fraud lawsuit filed by Michael Joseph.

The Motion to Dismiss filed by her lawyer, Joseph S. Geller on October 6, 2015, enabled Phyllis to avoid producing the requested documentation necessary to proceed with the case until the Court ruled on the Motion.  Now that the case is moving forward, the clock starts ticking.

Now that she’s finally out of excuses, Phyllis MUST comply!

The Plaintiff’s Request for Production listed 24 items relating to her last re-election campaign for city council, including (among other things) copies of contracts, bills, invoices, voter lists, copies of all communications (written or electronic) with various individuals (including Frantz Pierre, vendors, consultants, campaign workers, etc.), copies of documentation relating to payments made to campaign workers, as well as copies of checks for payment to anyone involved in her campaign.

Oh, yeah!

  1. This is big. A major legal hurdle has been overcome. Let the discovery — and truth — flow! Follow the money and the stench.

    1. Thank you for recognizing that! Child lobbyist Evan Ross is again trying to poison the well by trying to disseminate his “professional” opinion that this is a frivolous lawsuit. He’s completely wrong, as usual. Now that the lawsuit has been given the green light to proceed, the damning evidence should ultimately prove that absentee ballot fraud was at play in the last election. Furthermore, it should prove that Phyllis and Frantz were complicit in the crime. I can’t wait for the fun to begin.
