Hear Ye, Hear Ye!

Hear Ye Hear YeAn Emergency Special Meeting has been called for the North Miami Beach City Council tomorrow afternoon, Friday, February 21, 2014 at 3:00 PM.

I was advised by the City Clerk that “per charter the meeting was requested by the City Manager to the Mayor and the Mayor called the meeting.”

So, I took out my handy dandy Charter App…

Just kidding!  There’s no app for that!

But I did go directly to the Charter via the link on the City’s website and found Article V. – City Council, Sec. 24. Meetings, which states:

Pay special attention to the two last sentences that read:

Notice of such special meetings shall be delivered to members of the council and shall be posted on the front door of the city hall at least twenty-four hours prior to the holding of same. No business shall be transacted at any special meeting other than that for which the meeting was called.

What this clearly states is that the Notice/Agenda should have been posted by 3:00 PM today, February 20, 2014 in order for this Emergency Special Meeting to be called “per charter.”

As you can see by this screen shot taken at 4:12 PM today, although “[t]he topic is organizational structure”…

…the business for which the meeting was called is not provided in an Agenda form, nor has an Agenda been posted “at least twenty four hours prior to the holding of” the meeting “per charter.”

Somebody’s got some ‘splainin’ to do.

  1. I don’t see where it says it must be posted in “agenda form.” The charter merely states the notice of the meeting must be posted on the front door of City Hall, which it was, long before 3 p.m.

    1. Posting “on the front door of City Hall” has evolved into posting “on the website,” which is technically the portal (door) to the city. Agendas for regular meetings are always posted on the website well before “at least twenty-four hours prior to the holding of same.”

      HOWEVER, if you want to get real technical, the Charter sentence, “No business shall be transacted at any special meeting other than that for which the meeting was called,” makes it very clear that ONLY that business for which the meeting was called is to be “transacted.” THEREFORE, the original posting on the website, which states, “The topic is organizational structure,” does not spell out the business at hand. The Agenda which is now posted lists four, count ’em, FOUR separate items included in said “business.” Those FOUR separate items are what should have been posted, “at least twenty-four hours prior to the holding of same.”

      I must note here that I am NOT blaming the City Clerk for the late posting. It is NOT her job to type the Agenda. She can only post it to the website after it’s in her possession. I am, however, pointing a finger at whoever is supposed to type the Agenda.

  2. Why did they fire Darcy? Unless you have continuity, you’re always going got end up with a Cluster*Cuddle. The City Attorney does the bidding of the Mayor and the Council and advises them of their legal standing. What was the point of kicking her can down the road?
